Operator and terms of service
This is a translation. The Czech version is legally binding.
Effective from November 1, 2026.
1. Provider
The website wpchirurg.com and the services under the WP Chirurg brand are operated by:
Roman Mondek
IČO (Company ID): 88538826
Registered address: Bošilec 88, 373 65 Bošilec
Sole trader registered in the Czech Trade Register
Not a VAT payer
Email: [email protected]
2. Subject
These terms govern the provision of website maintenance, repair, speed optimization and security services (the "services") between the provider and the client, whether a consumer or a business. Different arrangements in an offer or contract take precedence.
3. Conclusion of the contract
The client describes the request by email. The provider sends an offer with the scope, price and estimated timeline. The contract is concluded when the client accepts the offer (by email). Communication is in Czech or another agreed language.
4. Price and payment
The price is stated in the offer. The provider is not a VAT payer; prices are final. One-off services are paid after completion based on an invoice due within 14 days, unless agreed otherwise. Subscriptions are paid monthly in advance. If it turns out during the work that the repair requires more than the offer covers, the provider stops the work and continues only with the client's new approval.
5. Procedure and cooperation
The provider first performs an initial diagnosis without changing the website and proposes a solution with a price. The initial diagnosis is free and non-binding; its result is a description of the cause found and a proposed solution, not the repair itself. Changes are made only after the client approves and a backup of the affected parts is made before each change. The client provides the necessary access and cooperation; the provider stores access credentials encrypted, uses them only to perform the contract and deletes them when the cooperation ends. The client is advised to change passwords after the job is completed.
6. Subscription
Subscriptions (Website monitoring, Website care) are concluded for an indefinite period. Either party may cancel by email as of the last day of a calendar month.
7. Consumer withdrawal
A consumer may withdraw from a distance contract within 14 days of its conclusion, by email (you can use the model form). If the consumer expressly requests that the service begin before this period expires, they will pay, upon withdrawal, a proportionate part of the price for the performance already provided (Section 1834 of the Czech Civil Code). Once the service has been fully provided with their express consent and acknowledgment that the right of withdrawal is thereby lost, withdrawal is no longer possible (Section 1837(a) of the Czech Civil Code).
8. Defects and complaints
If a repair does not work as agreed, please report it by email without undue delay. The provider handles the complaint without undue delay, for consumers within 30 days at the latest, preferably by removing the defect free of charge. The provider is not liable for defects caused by later interventions of third parties, updates outside its management or hosting failures.
9. Liability
The provider acts with professional care and makes backups before changes. It is liable for lost profits only to the extent that the law does not allow this to be excluded. Toward businesses, compensation for damage is limited to the price of the job.
10. Confidentiality
The provider keeps confidential everything it learns while working on the client's website. It may use experience from repairs to describe cases only in fully anonymized form from which the client cannot be identified.
11. Out-of-court dispute resolution
A consumer may resolve a dispute out of court with the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, adr.coi.cz. Supervision is carried out by the Czech Trade Inspection Authority and, in matters of trade licensing, by the competent trade licensing office.
12. Final provisions
The relationship is governed by Czech law, in particular the Civil Code. Personal data protection is described on the Privacy policy page.
